By a resolution of the customs of December 9, 2002, an open joint-stock company was found guilty of an administrative offense, the liability for which is provided for in part 2 of article 16.17 Administrative Code, and he was sentenced to 50 minimum wages for each cargo customs declaration, i.e. 5,000 rubles, totaling 20,000 rubles.
The basis for making this decision was the protocol on an administrative offense of November 25, 2002 and other materials of the case on an administrative offense, according to which OJSC, having concluded contract No. 301 with AS Silmet (Estonia) on October 30, 2002 (transaction passport dated January 31, 2001), exported a chemical concentrate of chlorides under 4 cargo customs declarations. At the same time, according to GTD No. 1, foreign exchange earnings in the amount of $ 159,156.40 were received in violation of the term of current currency transactions for 12 days; according to GTD No. 2, foreign exchange earnings in the amount of $ 163,251.40 were received in violation of the term for 7 days, for GTE No. 3, foreign exchange earnings in the amount of $ 160,703.40 arrived with a violation of the term for 15 days; for GTD No. 4, foreign exchange earnings in the amount of $ 67790.90 were received with a violation of the term for 11 days and in the amount of $ 100,000 - for 16 days.
